Terms of Service

By registering an institution or using FaceAttend, you agree to these Terms of Service. Please read them carefully. These terms are governed by the laws of Uganda.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Institution", "Administrator", or "User") and FaceAttend, operated by Ainebyona Abubaker ("we", "us", or "our"). By creating an account, registering an institution, or using the FaceAttend platform in any way, you agree to be bound by these Terms.

New institutions receive a 30-day free trial with full access to all features. No credit card is required during the trial. At the end of the trial period, continued use of the service requires a paid subscription. We reserve the right to suspend or terminate accounts that remain on an expired trial without converting to a paid plan.

Paid plans are billed on a monthly basis. All prices are listed in USD on our pricing page and are subject to change with 30 days notice. Failure to pay may result in suspension of your account. We do not offer refunds for partial months of service.

8. Data Ownership

You retain ownership of all data you submit to FaceAttend, including student records and attendance data. By using the service, you grant FaceAttend a limited licence to store and process this data solely for the purpose of delivering the service. We do not claim ownership of your data and will not use it for any purpose other than providing the service.

9. Data Protection

We process personal data in accordance with our Privacy Policy and the Uganda Data Protection and Privacy Act, 2019. Both parties agree to comply with applicable data protection laws. Institutions act as data controllers for student data; FaceAttend acts as a data processor on behalf of institutions.

10. Service Availability

We aim to maintain high availability of the FaceAttend service but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance where possible. We are not liable for any losses arising from temporary service unavailability.

11. Intellectual Property

All intellectual property rights in the FaceAttend platform, including software, algorithms, design, and branding, belong to FaceAttend and Ainebyona Abubaker. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the service as described herein.

12. Limitation of Liability

To the fullest extent permitted by Ugandan law, FaceAttend shall not be liable for:

These Terms are governed by and construed in accordance with the laws of Uganda. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts of Uganda.

We may update these Terms from time to time. We will notify registered institutions by email of any material changes at least 30 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
